An arrest in Los Angeles County sets off a fast-moving sequence of events. Knowing the timeline — and your rights inside it — can mean the difference between a loved one spending one night or several in jail. Here is what actually happens in the first 48 hours.
Hour 0–6: Arrest, transport, and booking
After arrest, the person is transported to a booking facility. In LA County this is frequently Men's Central Jail or Twin Towers in downtown Los Angeles, or a local sheriff's or police station holding facility closer to the arrest. Booking includes identification, fingerprinting, photographing, a property inventory, and a records check. This process can take several hours, especially at busy county facilities.
Your rights immediately after arrest
- The right to an attorney — including free legal help if the person cannot afford one.
- The right to make phone calls — under California Penal Code §851.5(a)(1), an arrested person has the right to make at least three completed telephone calls — immediately upon being booked and, except where physically impossible, no later than three hours after arrest. The calls are free if made within the local calling area.
- The right to remain silent — booking questions (name, address) are required; everything else can wait for an attorney.
Hours 6–24: Bail is set
For most charges, bail is determined from the LA County Uniform Bail Schedule without a hearing. The jail can usually tell family members the bail amount once booking is complete. This is the moment to contact a licensed bail agent: the sooner paperwork starts, the sooner release processing can begin.
Hours 24–48: Court appearance and release
If bail is posted quickly, the defendant may be released before ever seeing a judge. If not, an arraignment — the first court appearance — typically happens within 48 hours (excluding weekends and holidays), where charges are read and bail can be reviewed. A judge may lower bail, set new conditions, or release the person on their own recognizance.
How to speed up release
- Find out the exact facility and booking number.
- Confirm the bail amount directly with the jail.
- Call a licensed agent immediately — paperwork can begin while the person is still being processed.
- Have photo ID and basic information about the defendant ready (full legal name, date of birth).
- Ask whether the agent can post electronically or meet you at the facility.
Common mistakes families make
The biggest mistake is waiting — bail amounts don't drop by waiting, and every hour in jail is harder on the defendant. The second mistake is paying a full cash bail when a 10% bond would do. The third is calling an unlicensed "agent" or a service that isn't transparent about fees. Verify your agent holds a California license and ask for the total cost up front.
